Payment Integrity & Non-Payment Procedure

Why this page exists#

Payment model

Referral and platform compensation is calculated from the receiving-side GCI and economically deducted from the receiving agent's commission share. Payment is processed through the appropriate lawful commission-disbursement channel — the receiving broker, brokerage accounting department, title or closing company where permitted, Agent Lead Exchange's payment portal, or another approved lawful payment process. Agent Lead Exchange does not require or encourage direct salesperson-to-salesperson payments.

Agent Lead Exchange is a neutral marketplace that connects referring and receiving agents. Every interaction on this platform — claim, acknowledgement, status update, closing date, fee invoice — is timestamped, signed, and retained. That paper trail belongs to the parties to the referral; the platform's role is to record it accurately and deliver it to the right people automatically.

We are not attorneys, not a collection agency, and we don't chase commissions on anyone's behalf. Every member agrees, at signup, to the Master Referral Agreement, the Non-Circumvention covenant, and the procedures described below.

Procedure

The cure window timeline#

When ReferralProof™ — our automated system that cross-checks public closing records against leads claimed on this platform — matches a closing to a lead and no referral fee has settled, a commission cure case opens automatically.

    Quiet 48-hour pre-cure window

    Only the receiving agent is notified. They can settle the fee or rebut privately, before the referring agent is told a closing was detected. This protects honest mismatches from creating noise.

    Formal cure window opens

    If the receiver did nothing, the referring agent is notified and a 5-day cure window begins. The receiver can still (a) pay the referral fee or (b) submit a Dispute Intent.

    One automated reminder is sent.

    Cure deadline

    If the fee is paid, the case closes. If a Dispute Intent is submitted, a second 5-day window opens for the receiving agent to upload supporting evidence (closing statement, executed referral release, broker statement, etc).

    Evidence window closes

    Whatever each party submitted is timestamped, sealed, and attached to the audit packet. The case status updates automatically based on what was uploaded — paid on record, dispute on record, no response on record. Agent Lead Exchange records what happened; it does not decide who is right. A reasonable extension can be granted on request when the receiving agent shows good-faith engagement.

Current windows: 48-hour quiet pre-cure, 5-day cure, 3-day reminder, 5-day evidence, and a 3-day grace period after an insufficient-evidence finding. These may be adjusted from time to time.

When a closing is confirmed, the platform automatically assembles a closing packet and delivers it to the referring agent, the receiving agent, and the brokerage/title contact on file. When a cure case escalates, a complaint packet is automatically generated and delivered to the referring agent — no admin intervention required. Admins can re-send or re-generate if a record changes, but they don't build the documents from scratch.

Ethics & licensing exposure#

Professional context

Real estate licensees are bound by state license law and, in most markets, by NAR's Code of Ethics. Articles 6, 7, and 17 in particular address compensation, disclosure, and dispute procedures. A signed referral agreement combined with a documented breach is the precise fact pattern those rules anticipate.

If a cure case escalates and the receiving agent does not pay or provide a legitimate defense, the referring agent may, at their sole discretion, file a complaint with the state real estate commission, the receiving agent's broker, and the local REALTOR® association. The platform automatically delivers the full audit packet to the referring agent for use in those proceedings — but the decision to escalate, and any communications with regulators or counsel, belong entirely to the agents involved.

Enforcement

Platform sanctions ladder#

Membership on Agent Lead Exchange is conditional on paying earned referral fees. Confirmed non-payment without a legitimate dispute leads to the following, applied at platform discretion.

    "Unresolved cure case" badge, visible to other members inside the platform on the flagged agent's Agent Lead Exchange profile.

    Claim suspension

    Warning

    The member cannot claim new leads while a case is escalated.

    Reputation downgrade

    Warning

    Tier and 90-day score are adjusted; referring-agent payouts are paused.

    Removal

    Enforcement

    The member, and at platform discretion their organization, is removed from Agent Lead Exchange.

    Disclosure

    Terminal

    The audit packet is released to the referring agent. If subpoenaed or requested by a state regulator, the platform will respond as required by law.

Receiving agent support

If you're the one being asked to pay

The cure window exists to protect you too. If you believe no referral fee is owed — the lead never converted, the consumer was already in your pipeline, the closing was on a different property, etc. — file a Dispute Intent inside the case banner on the lead page. You get a full additional window to upload evidence, and reasonable extensions are granted on request. The platform's goal is the correct outcome, not the fast one.

Note: Agent Lead Exchange is a connector and audit platform — not a party to your transactions and not your attorney, CPA, or collection agency. You are responsible for collecting commissions owed to you.
